Affiliate Terms

Effective Date: 2026

These Affiliate Terms govern participation in the Black Label Picks Affiliate Program and Creator Partnerships (together, the “Program”), operated by Pro Esports Picks LLC, doing business as Black Label Picks (“we,” “us,” or “our”). By applying to or participating in the Program, you (“Affiliate” or “you”) agree to these Terms, our [Terms of Service], and our [Privacy Policy].

1. How to Apply

All applications are submitted through our [Affiliate Application Form]. On the form, select the program you’re applying for:

Standard Affiliate: open to anyone who meets the eligibility requirements below
Creator Partner: for content creators, streamers, and community leaders seeking custom terms

We review every application and will notify you by email of our decision.

2. Eligibility & Approval

You must be at least 18 years old.
All applications are subject to approval, and we may accept or reject any application at our discretion.
You must provide accurate information, including payout and tax information.
We may decline or remove affiliates whose content or audience conflicts with our brand, these Terms, or applicable law.

3. Program Tiers

Standard Affiliate
Standard affiliates earn the commission rates listed in Section 5.

Creator Partner
Approved Creator Partners receive custom commission rates, discount codes, bonuses, or other terms through a separate written agreement (a “Partner Agreement”). Email counts as a written agreement.

If a Partner Agreement conflicts with these Terms on rates, discounts, or payment, the Partner Agreement controls. These Terms govern everything else.
Partner Agreement terms are confidential and may not be disclosed publicly.
Creator Partner status may be reviewed periodically. If a Partner Agreement ends, the partner may continue as a Standard Affiliate at standard rates.

4. Referral Tracking

You will receive a unique referral link and/or discount code.
Referrals are tracked by cookie for [30] days from the click. If a visitor subscribes within that period, the referral is credited to you.
If a customer clicks more than one affiliate’s link, the last affiliate link clicked before purchase receives credit.
Use of your discount code at checkout credits the referral to you, regardless of cookies.
Referrals not properly tracked due to cookie blocking, device changes, or technical issues may not be credited. Our tracking records are final.

5. Commissions (Standard Rates)

Commission	Amount
Signup commission	$2.00 flat, one time, per new paying subscriber
Recurring commission	$1.50 per month, starting with the referred subscriber’s second paid month, for up to 12 monthly payments

Commissions are earned only on completed, paid subscriptions. Free trials, failed payments, and unpaid renewals do not earn commissions.
Recurring commissions end after 12 monthly payments, or earlier if the subscriber cancels or you leave the Program.
If a subscriber cancels and later resubscribes through your link, a new 12-month period begins.
Creator Partners may receive different rates and durations under their Partner Agreement.
We may change standard rates with at least 30 days’ email notice. Changes apply only to commissions earned after the effective date.

6. Follower Discount Codes

Standard Affiliate codes give new subscribers 10% off their first month. Creator Partner discounts are set in the Partner Agreement.
One use per customer, for new subscribers only.
The discount cannot be combined with other promotions.
Commissions are paid at the flat rates above regardless of the discount applied.

7. Payouts

Commissions are paid monthly, through our affiliate payout system, to the payout method on your affiliate account.
Commissions are subject to a [30]-day hold to account for refunds and chargebacks. For example, commissions earned in March are paid in [month/date].
The minimum payout is $25. Balances below the minimum roll over to the next payout period.
You are responsible for keeping your payout information accurate. We are not responsible for payments sent to incorrect details you provided.

8. Reversals

Commissions are reversed or withheld for:

Refunded or charged-back orders
Fraudulent, duplicate, or self-referred purchases
Referrals obtained in violation of these Terms

If a reversal occurs after payout, we may deduct the amount from future commissions.

9. Prohibited Practices

You may not:

Self-refer: use your own link or code for your own purchase or account, or for accounts you control
Make misleading claims, including “guaranteed wins,” “locks,” “can’t lose,” or earnings or profit claims about using Black Label Picks
Leak codes: post your discount code on coupon, deal, or code-sharing websites
Bid on our brand in paid search: bid on “Black Label Picks,” “CodPix,” “R6Pix,” “esportsstats.gg,” or variations in paid search ads
Spam through unsolicited emails, DMs, or comments
Impersonate us: create accounts, pages, or domains that appear to be official Black Label Picks channels
Target minors: direct promotions at anyone under 18
Share or resell VIP content: distribute our picks, stats, or VIP content

10. Disclosure Requirements (FTC)

You must clearly disclose your affiliate relationship whenever you promote Black Label Picks, as required by the Federal Trade Commission. For example:

“#ad,” “#affiliate,” or “I earn a commission if you sign up with my link”
The disclosure must be clear and visible: in the video or stream itself and in captions or descriptions, not hidden in a link tree or at the end of a long post.

You are solely responsible for complying with FTC guidelines, platform rules, and advertising laws that apply to your content.

11. Brand Use

We grant you a limited, revocable, non-exclusive license to use our name, logos, and approved marketing materials solely to promote the Program. You may not alter our logos or create content that damages our brand. We may request removal of any content that misrepresents us, and you agree to comply promptly.

12. Taxes

You are responsible for all taxes on your commissions. We may require a completed W-9 (U.S. affiliates) or W-8BEN (non-U.S. affiliates) before issuing payouts, and we will issue tax forms where required by law.

13. Independent Contractor

You are an independent contractor, not an employee, partner, or agent of Pro Esports Picks LLC. You may not make commitments or statements on our behalf.

14. Termination

Either party may end your participation at any time, for any reason.

If you leave or are removed in good standing, earned commissions that meet the minimum payout and clear the hold period will be paid in the next payout cycle. Recurring commissions stop on the termination date.
If you are removed for violating these Terms, all unpaid commissions are forfeited.

15. Existing Affiliates

Affiliates who joined before the Effective Date will continue to receive recurring commissions under their previous terms for subscribers they referred before the Effective Date. All referrals made on or after the Effective Date follow these Terms, including the 12-month recurring limit.

16. No Guarantees

We do not guarantee any level of earnings, referrals, or commissions. The Program, tracking systems, and payouts are provided “as is,” and we are not liable for tracking errors, downtime, or lost commissions beyond correcting verified errors.

17. Limitation of Liability

To the fullest extent permitted by law, our total liability to you under the Program will not exceed the commissions paid to you in the 6 months before the claim arose. We are not liable for indirect, incidental, or consequential damages, including lost profits.

18. Changes to These Terms

We may update these Affiliate Terms. We will notify affiliates of material changes by email at least 14 days before they take effect. Continued participation after that date means you accept the changes.

19. Governing Law & Disputes

These Terms are governed by the laws of the State of Nevada. Disputes are resolved under the arbitration and class-action waiver provisions of our [Terms of Service].
